Welcome to lilyandthistle.com and related sites as operated by Lily and Thistle, LLC. These are our terms of use if you wish to access our website and its services or products. If you do not agree to these rules, you cannot use our site. We reserve the right to change these rules at any time and will post the updated rules on our site, which you may or may not notice. We have intentionally written them in a way that aims to avoid legalese, so that everyone can clearly understand and agree to the rules, as well as their rights and responsibilities. We hope there won’t be any problems and that you will reach out to us if you are having issues with our site, service, or products, including having any accessiblity issues. 1.0 Site Services

We agree to provide you with services, or the “Service(s)” “Site. In exchange for providing this service, we require you to follow these rules:

“Course Materials” means all videos, downloads, written content, quizzes, templates, and other instructional materials provided as part of the online art curriculum.

“Member Content” means any comments, artwork, forum posts, or other content you upload or post while using the Platform.

“Platform” means our website, learning dashboard, mobile apps, and any associated services through which Course Materials are delivered.

“Subscription Period” means the length of time you are entitled to access Course Materials under your chosen plan.

“User,” “you” or “your” means the individual or entity registering for or using the Platform.

“We,” “us,” or “our” means Lily and Thistle, LLC, its affiliates, and licensors.

Our Guidelines

  1. You must be at least 13 years old to use the Site, or if you are a resident of the EU, you must be at least 16 years old. Don’t lie about your age. If you are under 18, you agree that a parent or legal guardian agrees to these rules on your behalf.
  2. Don’t use the Site to do anything illegal or break the rules in our terms of use.
  3. Don’t change anything about our website or applications, upload any type of virus or malware, or do anything that might interfere with the way the Site or its services works.
  4. Don’t do anything that might affect how other people use and enjoy the Site. Be a good neighbor.
  5. Don’t encourage anyone to break these rules.
  6. Use your common sense, and be a good human.
  7. If you participate in any community features, including posting content in a Facebook Group, discussion board, or as part of a closed group, don’t post anything violent, or anything that promotes violence or violent groups, or that might make other people feel scared.
  8. Don’t post content that contains nudity, sexual violence, or commercial sexual services.
  9. Don’t post content that promotes crime or anything that would break United States law.
  10. Do not post content related to certain regulated goods, like selling or trading non-medical drugs, pharmaceutical drugs, or marijuana.
  11. Don’t bully anyone or post anything horrible about people. By bullying, we mean making a degrading statement about someone or posting inappropriate images that threaten someone. If you wouldn’t say it to someone’s face, you shouldn’t say it on the Site. And if you can’t say anything nice or at least constructive, maybe you shouldn’t say anything at all. 
  12. Don’t post personal or private information about someone else. This includes someone’s contact information, like their phone number, address, email, location, or other private details.
  13. Don’t post stuff that doesn’t belong to you or infringes upon someone else’s intellectual property.
  14. Don’t use anybody else’s account without their permission or try to find out their login details.
  15. Don’t let anyone else use your account. Keep your password secret.
  16. Don’t set up an account with someone else’s name, including a famous person or company. If you lie when you set up an account, you can be kicked off forever.
  17. Don’t use any type of software or robot to create accounts or access Site, and don’t use it send spam or unwanted messages to others.
  18. Don’t register an account if your previous account was disabled or you were kicked off for violating our rules.
  19. Don’t register for an account if you are not allowed to under any other applicable laws in your jurisdiction.

2.0 Your Rights

2.1 Subject to these Terms, we grant you a personal, non-exclusive, non-transferable license to access and view the Course Materials solely for your own educational use.”

You have the right to feel safe using Site.

2.2 You have the right to your privacy on Site. Please refer to our https://www.lilyandthistle.com/privacy-policy for details.

2.3 Any communications made through our contact page, blog, blog comments, newsletter sign-up, membership portal, Facebook group, learning community, or other pages, or directly to us through phone, mail, or email are not confidential and are subject to viewing, reproduction, and distribution by us and our licensed third parties. We own any and all communications displayed on our website, servers, comments, emails, or other media as allowed by United States law, and we do not promise to give credit or pay compensation/royalties for unsolicited user-generated content. For more information on when and how we store and use your communications or any data provided by you in those communications, please refer to our Privacy Policy as linked above.

We reserve the right to republish or distribute anything you upload to our sites. You agree not to submit any content that could be illegal or serve an unlawful purpose, including, but not limited to, content that is potentially libelous or maliciously false, obscene, abusive, negligent, infringing, or otherwise harmful or inappropriate.

2.4 If you are a resident of the EU, you have the right to be forgotten and can delete your account and the content on your page at any time by logging in and completing a delete request. It may take a few days to process and may be visible by others in the meantime. Some of your content that was on other accounts or pages or that was shared may survive and may not be deletable. Please think before you post. We may also keep your registration information for as long as we need to do to run our business and to follow these rules.

2.5 You are responsible for anything you do on Site under your login, including things you post and comment on. You are responsible for making sure the stuff you post belongs to you, including any music or photos. If you post something you shouldn’t and get a fine,you will have to pay it.

2.6. Termination by You. You may cancel your subscription or delete your account at any time via your account dashboard or by emailing support@lilyandthistle.com. Cancellation takes effect at the end of your current Subscription Period; no prorated refunds will be issued.

2.7. Survival. Sections that, by their nature, should survive termination—such as License Restrictions, Intellectual Property Rights, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Entire Agreement—shall remain in effect even after your access ends.

3.0 Our Rights

3.1 We are not responsible for the following:

  1. Links to other companies or websites, even when the link shows up in Site.
  2. What happens when you connect your Site account to another website or service, including sharing a picture or video. You should read the rules for that service to know your rights.
  3. The data cost on your mobile device for using Site or its services.
  4. Any content that is stolen or copied from the Site by someone else.

3.2 We can end the Site and its services at any time or stop you from using Site at any time for any reason without letting you know beforehand. We can also delete content you have uploaded for any reason, whether you think that content violates our rules or not. We do not have to pay you if we delete content that was making you money.

3.3 We reserve the right to change your username or to reset your password for any reason.

4.0 Intellectual Property Rights 

4.1. Our Content

All images, text, designs, graphics, trademarks and service marks are owned by and property of Lily & Thistle, LLC, or the properly attributed party. It is a violation of federal law to use any of our intellectual property in whole or in part, and modification of any materials contained on this Site is illegal and may be prosecuted to the fullest extent permissible, including asking for financial penalties (damages) and/or an injunction forcing you to stop using our intellectual property immediately. Do not try to use our stuff, remove it, change it, or claim to be us without written permission.

 

You may NOT use our intellectual property in any way, which includes copying and pasting any text, screenshotting or reposting an image, design, or other property on another site, whether it is yours or someone else’s, including posting a quote or image on social media. NOT ALL SHARING IS CARING. We have invested a lot of time and money into creating our intellectual property, and we respect intellectual property rights—as should you. Karma is real; don’t steal.

We reserve the right to suspend, disable, or terminate the accounts of users who repeatedly infringe or are repeatedly charged with infringing the copyrights, trademarks, or other intellectual property rights of others.

We may modify or retire Course Materials at any time; we’ll use reasonable efforts to notify active members of any major changes.

License Restrictions. Unless we give you express written permission, you agree not to:

  1. Copy, reproduce, distribute, publicly display, or create derivative works of the Course Materials;

  2. Sell, sublicense, rent, lease, or otherwise commercially exploit the Course Materials;

  3. Share your login credentials or allow others to use your account;

  4. Remove, obscure, or alter any proprietary notices or watermarks included with the Course Materials.

4.2. DMCA

The Digital Millennium Copyright Act of 1998 (the “DMCA”) provides recourse for copyright owners who believe that material appearing on the Internet infringes their rights under U.S. copyright law. If you would like to read the DMCA, please visit the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf.

If you believe in good faith that materials on the Site infringe your copyright, the DCMA provides that you (or your agent) may send us a notice requesting that the material be removed or access to it blocked.

The notice must include the following information:

  • the physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
  • identification of the copyrighted work claimed to have been infringed (or, if multiple copyrighted works located on the Services are covered by a single notification, a representative list of such works);
  • identification of the material that is claimed to be infringing or the subject of infringing activity, and information reasonably sufficient to allow Company to locate the material on the Services;
  • the name, address, telephone number, and email address (if available) of the complaining party;
  • a statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
  • a statement that the information in the notification is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Notices must meet the then-current statutory requirements imposed by the DMCA. Notices and counter-notices with respect to the Services can either be sent:

We suggest that you consult your legal advisor before filing a notice. Also, be aware that there can be penalties for false claims under the DMCA.

5.0 This Agreement

5.1 If you use other third-party services on the Site, including payment services, you will need to follow those rules or terms. If any of those rules conflict with these rules, those rules will win.

5.2 If a court finds any of this Agreement unenforceable, the other rules will still be valid.

5.3 Any changes to these rules must be made in writing. If we fail to enforce any of these rules for any reason, we still have the right to enforce them in the future, and our behavior will not be a waiver of our overall rights in this Agreement.

5.4 We reserve all the rights we did not expressly grant or tell you about in this Agreement.

5.5 No one else besides you and us (no third parties) have rights under this agreement.

5.6 You cannot give these rights or obligations to someone else without our consent. We can give our rights and obligations to someone else, however, like if we change ownership by selling part or all of our business, or if we need to for legal reasons.

6.0. Advertising, Affiliates, and Testimonials

This site may use advertising or affiliate links to sell certain products or services. We disclaim any and all liability as a result of your purchase through one of these links. We will use reasonable efforts to notify you when and where we have placed ads or affiliate links in addition to this disclaimer located in these Terms & Conditions. You accept express liability for any and all consequences or benefits of clicking the affiliate links contained on this website or related communications. Any testimonials reflect the accurate experience of the person quoted, however, your results with any particular product or service may vary.

7.0 Refunds & Payment 

We like to have fun, but we take our business seriously. We’d appreciate your careful consideration of the services and products available on the site, and we advise you to make your purchases carefully.

Due to the nature of the services and/or products provided, refunds are limited to the 14 days from purchase.  Any refund request must be submitted in writing (via our customer support at support@lilyandthistle.com) and the Company given at least 14 days to respond before a chargeback is filed. Any refund request or disputed payment made after the 14-day refund window has closed will be denied according to these terms and conditions, as agreed upon by you, the Customer, prior to purchase of the product. 

Payment are due in full at the time of purchase and we reserve the right to pursue payment, including collections and attorney fees, for any failed or overdue payments. You as a customer, agree to pay for all the goods and services you have ordered. 

7.2. “Lifetime Access”

When we say “lifetime access,” we mean the lifetime of the product, not the lifetime of the customer. You’ll be able to log in and use a product for as long as it’s available for sale. This doesn’t mean your personal lifetime, and it doesn’t confer any ongoing financial value, credits, or usage beyond the product itself.

7.3. Subscription Authorization & Cancellation

By enrolling in any Membership or Subscription, you expressly authorize us to charge your chosen payment method on a recurring basis at the then-current subscription rate. Charges will occur automatically at the start of each billing cycle until you cancel. To stop future payments, you must cancel your subscription before the next billing date through your account settings dashboard. No refunds will be issued for billing periods already commenced.

8.0  Limits on Liability

8.1 Site operates as is, and we can’t guarantee it will be safe and secure or will work perfectly all the time. Sometimes crazy things and mistakes happen, even when we try to find reliable vendors to help us operate the Site and its services. TO THE EXTENT PERMITTED BY LAW, WE ALSO DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not control or direct what people and others do or say, and we are not responsible for their actions or conduct (whether online or offline) or any content they share (including offensive, inappropriate, obscene, unlawful, and other objectionable content). We also aren’t responsible for services and features offered by other people or companies, even if you access them through our Service. You should read and agree to their rules and terms.

8.2 We cannot predict when issues might arise with our service. Accordingly, our liability shall be limited to the fullest extent permitted by applicable law. We are not responsible for lost profits, data or any kind of damages connected to you using the Site. The total limit on our liability to you under these Terms is the greater of: $100 or the amount you have paid us in the past twelve months.

8.3 You agree to defend (at our request), indemnify, and hold us harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable attorney’s fees and costs, arising out of or connected with these Terms or your use of the Service. You will cooperate as required by us in the defense of any claim. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you may not settle any claim without our prior written consent.

8.4 Nothing on the site, or offered through its services or products, is intended to diagnose or treat any physical or mental illness. No information on the site is intended to be legal, medical, or financial advice and is for educational purposes only, unless clearly marked otherwise.

8.5. Force Majeure. We will not be liable for any delay or failure to perform our obligations under these Terms if such delay or failure is due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, government action, internet outages, or third-party service disruptions. In such events, we will use commercially reasonable efforts to resume performance as soon as practicable.

9.0 How We Will Handle Disputes

9.1 We hope there won’t be any problems and that you will reach out to us if you are having issues with our service. However, if you have a legal issue with the Site, you agree to use binding arbitration under the AAA, which means you will not be able to go to court individually or with others, nor participate in a class-action lawsuit or arbitration. You agree to waive a trial by jury. The following claims don’t have to be arbitrated and may be brought to court: small claims, intellectual property disputes (like copyrights and trademarks), or efforts to interfere with the services or engage with the service in unauthorized ways. A court can also decide issues about the scope and enforceability of these arbitration provisions.

9.2 For any claim that is not arbitrated or resolved in small claims court, you agree that it will be resolved exclusively in the U.S. District Court for the District of Nevada or a state court located in Nevada. You also agree to submit to the personal jurisdiction of either of these courts for the purpose of litigating any such claim.

9.3 The laws of the State of Nevada , to the extent not preempted by or inconsistent with federal law, will govern these Terms and any claim, without regard to conflict of law provisions.

10.0 Accessibility 

Lily and Thistle, LLC is committed to ensuring that our website, products, and online course platform is accessible to everyone, including individuals with disabilities. We strive to comply with the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA and applicable accessibility laws, including the Americans with Disabilities Act (ADA).

  • Standards & Testing. We continually review and update our site and course materials—text, images, video, and interactive elements—to meet WCAG 2.1 Level AA standards.

  • Ongoing Improvements. While we work hard to make all content accessible, we recognize that occasional issues may arise. We actively monitor feedback and implement fixes as quickly as possible.

11.0 SMS Text Messaging
If you choose to provide your mobile phone number when enrolling or via your account settings, you expressly authorize Lily and Thistle, LLC and its affiliates to send you SMS text messages—such as course reminders, updates, and promotional offers. Message frequency may vary; message and data rates may apply.

  • Opt-In Condition. You will only receive SMS messages if you have supplied a valid mobile number.

  • Opt-Out. To stop receiving SMS messages, reply “STOP” to any SMS or email us at  support@lilyandthistle.com. You’ll receive one final confirmation message.

  • Help. For help, reply “HELP” to any SMS or contact  support@lilyandthistle.com.

  • Privacy. We will handle your mobile number in accordance with our Privacy Policy. Providing a mobile number is voluntary and not required to make a purchase.

Please ensure the number you provide can receive SMS. We aren’t responsible for undelivered messages due to carrier or device issues.

12.0 Entire Agreement. These Terms, together with our Privacy Policy and any documents expressly incorporated by reference, constitute the entire agreement between you and Lily and Thistle, LLC regarding your use of the Platform and supersede all prior or contemporaneous communications, proposals, or agreements—whether electronic, oral, or written—between you and us concerning the same subject matter.

Promotion – Art Makes Me Smart Enrollment in Annual or Lifetime Access Giveaway

The terms and conditions apply to the New Customer Enrollment in Annual Membership or Lifetime Access Membership to any customers who purchase the Art Makes Me Smart Membership for the first time (“Promotion”). By entering this Promotion, you will be deemed to have read and understood these terms and conditions and will be bound by them.

Who May Enter

The Promotion is open to residents worldwide aged 18 or over, except for any employees (or family members of employees) of the Promoter, their families or anyone else connected with the planning or administration of this Promotion (“Participant”).

How to Enter

To take part in this Promotion, you will need to be a first-time purchaser of the Art Makes Me Smart Membership paying under the Annual Membership or Lifetime Membership and have not been previously enrolled in another pricing plan (“Customer”).  Each Customer will automatically be entered, unless Customer specifically opts-out by emailing support@lilyandthistle.com (“Entry”).  Only one submission per Customer will be permitted.

Closing Date

The Promotion for Current Members begins at 5:00am (Pacific time) on Tuesday, July 15, 2025 and closes at 11:59pm (Pacific time) on July 20th, 2025 (“Promotion Period”). Entries received after the Promotion Periods will not be counted.

Winner Selected and Notification

The first twenty-five winners will be selected from all complete, correct and eligible entries received by the closing date.

The winner will be notified by email from support@lilyandthistle.com no later than 11:59pm Pacific on July 31, 2025.

Prize

The prize for the Promotion includes one free tote bag and sticker (“Prize”).

Additional Terms & Conditions for All Promotions

Please note that the brands featured are in no way affiliated with these Promotions.

The Promoter may substitute the Prizes (or any part of the Prizes) for a prize or prizes of equivalent or greater monetary value if this is necessary for reasons beyond the Promoter’s reasonable control. There is no cash alternative to the Prize (or any part of the Prizes) and the Prize is non-refundable and non-transferable.

If any winner is not able to accept the Prizes for any reason, cannot be contacted within 14 days of the draw date, or fails to provide any required proof of age or consent, the Promoter reserves the right to award the Prizes to another entrant.

Liability etc

  • There are certain things for which the Promoter does not accept any liability to you, and these are explained in the next two paragraphs. The law does not allow the Promoter to exclude or limit its liability for some things, such as death or personal injury caused by its negligence, or loss caused by a false statement where the statement is made fraudulently. The Promoter accepts full liability for these matters. Otherwise, the exclusions of liability described in paragraphs 17 and 18 will apply. References to the “Promoter” in these paragraphs (16, 17, 18) include all of the Promoter’s associated companies, agents or any other third party involved in the Promotion.
  • The Promoter will not be responsible for (and will have no liability in connection with) the following occurrences, to the extent that they occur for reasons beyond the Promoter’s reasonable control:
    1. any postponement or cancellation of the Promotion; and
    2. any changes to prizes or the way in which they can be used;
    3. problems with the dispatch of prizes (such as prizes failing to reach the intended recipient); and/or
    4. any act or default of any third party supplier.
  • The Promoter does not accept responsibility for network, computer, hardware or software failure of any kind, which may affect the sending, receipt or processing of your entry.
    Entries must not be made through agents or third parties. Incomplete entries will be disqualified and will not be counted.
  • The Promoter’s decision is final and binding in all respects on all entrants. No correspondence will be entered into. Entries that do not comply in full with these terms and conditions will be disqualified.
  • Please note that this Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Instagram, or any other social media platform.
